AVAILABILITY AND DELIVERY
All Tomorrowland Apparels Pvt Ltd (TAPL) products are built to order. Delivery time will vary from product to product and cannot be guaranteed. An indicative time period is approximately 14 days including shipping time. Garments designed with international fabrics may take up to 21 days for delivery. Shipping delays due to courier companies cannot be controlled by TAPL.
If a fabric chosen by you is found to be sold out or has a delay in delivery from the manufacturer post-purchase, we will offer you similar options. If the options are not suitable, a refund will be provided for the shirt in question (unless clubbed with a promotional offer). Items purchased via a gift voucher are also not entitled to a refund in cash or credit.
You agree that any use on the site is at your own risk and TAPL is not responsible for it. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Your unique identifier is your email ID or mobile phone number. You are responsible for updating the same as we will send all communication on your order status and delivery details to your unique ID only. Further, adding your mobile number to the account information allows us to contact you in case of any requirements to schedule appointments, alterations, advise delivery of orders as well as any unforeseen circumstance.
You may at any time unsubscribe from our newsletters, email or SMS campaigns by clicking on the appropriate settings in your Profile on our website.
TAPL tries to be as accurate as possible in the representation of information on the website and in our stores. However, TAPL does not warrant that product description or other content of this site is accurate, complete, reliable, current, or error-free.
Our customization software is a computer render of the actual fabric. Colours and patterns may appear different based on the screen resolutions being used. The final shirt may differ slightly from that of the image being displayed.
Every fabric has a unique weight, feel and fall- hence measurements may appear to be different. Please be prepared for slight variances in fit based on fabrics.
All measurements provided are final shirt measurements and shirts will produced within a general 0.5" tolerance of those measurements.
We now have a single repository for measurements for a customer's garment. The most recent version of the measurements will be referred to as the base measurement for the customer profile.
Your base measurements stay linked to your profile.
Any updates done from the profile page will update the base measurement and will be applicable to open orders (not in production)
Changes made while creating/editing an order will update the base measurement and link the base with open orders
Changes made while creating/editing alterations will update the base measurement, open orders (not in production) and other open alterations
Once your order/alteration goes into production, the measurements are frozen for the particular order. Any measurement changes from the profile or other orders won't be applied to this order.
If your account is used by family member/relative or acquaintance and their measurements are stored on the system, then TAPL will alter the same if possible, at a cost to the customer. No refunds or cancellations of these orders will be accepted.
Whilst we try to ensure that all details, descriptions and prices that appear on this Website are accurate, errors may occur. If we discover an error in the price of any Product or Service that you have ordered from TAPL, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled.
We allow changes or cancellations within 24 hours of order placement. If you cancel and you have already paid for the Product or Service, you will receive a full refund. Refund will be made via the same payment mode and will be credited within 7 working days after the refund is initiated. Our prices for India are inclusive of GST. For shipments outside of India, you will be solely responsible for calculating and paying any and all taxes, customs duties, fees, etc. imposed by the destination country in relation to the Product(s) or Services. Delivery costs may be charged in addition; such additional charges are displayed where applicable and included in the total cost.
For our international customers, please note that all charges are in the currency displayed on the website. In case of any inter Bank fees, TAPL has no control in determining what these charges are and it is understood that customer will bear these charges (if any). In case of any outstanding amount, TAPL has the right to use the loyalty credits accumulated by the customer to offset these charges.
In case where a refund is issued, we will not refund any shipping charges, custom duties or taxes as applicable.
Items purchased on Sale at our Stores are not eligible for returns, refunds or alterations.
Effective November 2020, our domestic prices are inclusive of GST at our stores and on our website in India. Payments may be made by Master Card or Visa. The safety of your Credit/Debit Card information is of paramount importance to us. We do not store any credit/debit card information and your payment details are automatically encrypted when you enter them. Upon receiving your order we carry out a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Products will not be dispatched, and Services will not be performed, until this pre-authorization check has been completed. Your card will be debited once the order has been accepted.
Gift Vouchers cannot be purchased using Loyalty Points/ Store Credits.
TRADEMARK, COPYRIGHT AND RESTRICTION
This site is controlled and operated by Tomorrowland Apparels Pvt. Ltd. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by us or by other parties that have licensed their material to us. Material on www.bombayshirts.com web site owned, operated, licensed or controlled by us is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by e-mail or other electronic means. Directly or indirectly you must not assist any other person to do so either. Without the prior written consent of the owner, modification of the materials, use of the materials on any other web site or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.
Tomorrowland Apparels Private Limited (“Tomorrowland”) acknowledge that the name of our city was changed from Bombay to Mumbai by the Corporation Resolution No. 512 dated August 12, 1996, Maharashtra Act, XXV of 1996.
The name “Bombay Shirt Company” pays tribute to the heritage of tailoring in our city, in an era when Mumbai used to be known as Bombay. Tomorrowland does not in any manner intend to disrespect or hurt anybody’s sentiments by referring to Mumbai as Bombay.
TAPL values its customers and respects their privacy. We collect customer information in an effort to improve your shopping experience and to communicate with you about our products, services and promotions. TAPL recognizes that it must maintain and use customer information responsibly. We will not rent, give (we do give their address, name etc. to the delivery companies, so we should clarify the language here so that it is given only for the purpose of completing the transaction and to the extent necessary for the same) or sell your personally identifiable information to any outside organisation for that organisation's own use without your consent. Your data will not be provided to third parties for marketing. We do not store any credit card information.
CHANGES TO TERMS OR SERVICES
We reserve the right to update or modify these Terms and Conditions at any time in our sole discretion. If we do so, we'll let you know either by posting the modified Terms on the Sites or through other communications. It is important that you check these terms regularly because if you continue to use the Services after we have posted modified Terms on the Sites, you are indicating to us that you agree to be bound by the modified Terms. You may choose to discontinue to use our service if you don't agree to be bound by the modified Terms. Because the Services are evolving over time, we may change or discontinue all or any part of the Services, at any time and without notice, in our sole discretion.
ALERTS AND NOTIFICATIONS
As part of our Services, you may receive notifications, alerts, emails, requests for feedback on our products and services, delivery status messages or other types of messages regarding our Services. We may also periodically send you emails that directly promote the offerings of TAPL. When you receive such promotional emails from us you will have the opportunity to "opt-out" by following the UNSUBSCRIBE instructions provided in the email you receive.
For all purchases made online and in stores, TAPL’s liability extends to the value of the products purchased by the customer.
RETURNS / ALTERATIONS
For Returns and Alterations, please take a look at our policy. The discretion to accept alterations / returns remains the sole right of TAPL.
If your first garment can be altered, no remake will be issued. If, however, your garment cannot be altered successfully, we will remake it free of charge. The decision is our sole discretion.
For a remake to be initiated, the garment needs to be shipped back to TAPL. As soon as we acknowledge that the garment has been received, the process will be initiated.
Effective 15 July, 2020, we are discontinuing issuance of Loyalty Points each time you buy a shirt. Loyalty Points will now be treated as Store Credit. Points previously earned through shopping online or through our Stores, are all credited to your online profile. These points may be redeemed through any of the above channels in the future. Loyalty points issued in lieu of a cancellation, refund or via purchase of a gift card have been increased by the GST rate (12%) in value and the difference credited to your account as of this date. Loyalty Points earned via any other means remain unchanged.
To view your account balance, simply login to your online profile.
Sign up bonuses are only available for profiles created online and not on stores. The validity of this is 1 month and we do not provide extension of the timeline. Loyalty Points are non-transferable from one account to other.
Loyalty points cannot be redeemed as cash and expire after 365 days of issue.
The company reserves the right to change the terms of the loyalty program.
TAPL may at times offer promotional codes to our customers to avail of special discounts and offers. The promotional codes cannot be used in conjunction with any other offers. Promotional codes are also not valid on purchases using Loyalty Credits. Orders using promocodes are not entitled to Loyalty points.
GOVERNING LAW AND JURISDICTION
This Agreement shall be interpreted and construed in accordance with the laws applicable in India. The courts of Mumbai, India shall have exclusive jurisdiction in any matter relating to or arising out of this Agreement.
Gift vouchers can be purchased at our stores, our website or through partner portals as electronic gift vouchers. The following conditions will apply in regard to their validity and redemption:
Items purchased via a gift voucher are also not entitled to a refund in cash or credit
The redemption of Gift Cards is restricted to the currency and territory that they are purchased in. Cross-border redemption of Gift Card’s is not permitted.
Gift Vouchers cannot be purchased using Loyalty Credits.
All gift vouchers have a validity of 1 year from the date of purchase. They cannot be refunded in cash or credit to the beneficiary or the purchaser
